Supreme Court Upholds General Chea Nusith’s Conviction with Dud Cheque

The Supreme Court on January 19, 2023  issued an arrest warrant for a high-ranking-military officer working with the Royal Cambodian Armed Forces (RCAF) accused of issuing five dud cheques to settle a debt of more than $600,000 to a private microfinance company in 2019.

The arrest warrant was made after he had lost his appeal, through his lawyer, against his conviction in absentia by the Phnom Penh Municipal Court for the offence.

 Presiding Judge Nil Nonn named the accused as Lieutenant-General Chea Nusith, 53, living in Phnom Penh’s Toul Tumpoung II commune. 

Judge Nonn said that the accused was sentenced in absentia on October 14, 2020 by the Phnom Penh Municipal Court to 18 months in prison and fined 3 million riels (about $725). 

The municipal court also ordered him to pay a total of $677,000 to  the  owner of a private microfinance  company, the plaintiff in the case.

 He was charged with issuing dud cheques under Article 231 of the Law on Negotiable Instrument and Payment Transactions. 

Judge Nonn noted that the Phnom Penh Court of Appeal had upheld his conviction on December 20, 2021.

According to the court’s document, in 2018, the accused borrowed nearly $1 million from  the representative of the private microfinance company for his personal use. 

He paid monthly installments to reduce the debt but on November 4, 2019, he issued five cheques to settle the remaining amount of $677,000 to the private company.

However, when the plaintiff went to collect the cash from the bank, the cheques bounced.

To claim for losses, the plaintiffs later lodged the lawsuit against the accused at the end of November 2019, which led to his arrest on December 11, 2019. He was later released on bail.

Both Lt-Gen Chea Nusith and his lawyer Muong Thunleap could not be reached for comment.
